Welcome to Pratt Merchant Services. These Terms and Conditions ("Terms") govern your access to and use of the services provided by Pratt Merchant Services Merchant Services, a brand within the Pratt Family & Co. portfolio ("we," "us," or "our"). By accessing our website at www.prattmobile.com or utilizing our merchant processing services, you ("Merchant," "you," or "your") agree to be bound by these Terms.
Acceptance of Services
By enrolling in our services, you agree to comply with all applicable laws, the rules of the Payment Card Industry (PCI), and the specific operating regulations of the card networks (Visa, Mastercard, American Express, and Discover).
The Pratt Merchant Services Program
Dual-Pricing / Cash Discounting
You acknowledge that our program may include Dual-Pricing or Cash Discounting models designed to reduce or eliminate merchant processing fees. It is your responsibility to ensure proper signage is displayed at your place of business as provided by us to remain compliant with local regulations.
Accountability
We operate with a standard of transparency. We provide direct support and do not utilize third-party aggregators that compromise the security or integrity of your funds.
Fees and Payments
Transparency
All fees associated with your account will be disclosed in your specific Merchant Processing Agreement (MPA).
No Long-Term Contracts
Unless otherwise stated in a specific promotion, Pratt Merchant Services operates on a month-to-month basis. You may terminate your service at any time by providing written notice 30 days in advance.
Equipment
Hardware provided at no upfront cost remains the property of Pratt Merchant Services unless purchased outright. Upon termination of service, all non-purchased equipment must be returned in good working condition within 15 days to avoid a replacement fee.
Security and Data Privacy
Compliance
We utilize Tier-1 PCI-compliant encryption. You agree not to store sensitive cardholder data (such as CVV or full track data) on your local systems.
Privacy
Your use of our services is also governed by our Privacy Policy. We collect and use information solely to provide and improve our merchant services and will never share your data with unauthorized third parties.
Prohibited Activities
You agree not to use Pratt Merchant Services for any illegal purposes, including but not limited to:
- Fraudulent transactions.
- Sale of restricted or illegal goods/services as defined by federal or state law.
- Activities that violate the Card Network Operating Rules.
Limitation of Liability
To the maximum extent permitted by law, Pratt Merchant Services and its parent company, Pratt Family & Co., shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use our services, including but not limited to loss of profits or data.
Indemnification
Merchant agrees to indemnify and hold harmless Pratt Merchant Services and Pratt Family & Co. from any claims, losses, or liabilities arising out of the Merchant's breach of these Terms or the Card Network rules.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action regarding these Terms must be filed in the courts located in Dallas County, Texas.
Changes to Terms
We reserve the right to update these Terms at any time. Changes will be effective immediately upon posting to www.prattmobile.com. Your continued use of the services after such changes constitutes your acceptance of the new Terms.
